Will Barr restore the integrity and credibility of the Justice Department?

In Fox News, Gregg Jarrett explains how Rosenstein

acted improperly and without justification to create the special counsel position filled by Mueller.

First, since Sessions had recused himself from the Russia investigation, there was no conflict of interest. A special counsel can only be created when such a conflict exists.

Second, at the time Mueller was appointed to lead the Russia investigation, it was a counterintelligence probe – not a criminal investigation. There is no provision in the law to appoint special counsels to investigate counterintelligence matters.

Third, when Mueller was appointed there was no evidence of a suspected crime, as required in order to appoint a special counsel.

...Having authored the memo advocating the termination of Comey, Rosenstein became a “fact witness” in any potential, albeit specious, obstruction of justice case against President Trump. Indeed, he was interviewed as such by the special counsel.

Yet, unbelievably, Rosenstein continued to preside over the very case in which he is a witness. This violates federal regulations and the Code of Professional Responsibility that dictates the conduct of lawyers. It also violates plain commonsense.

...Once Barr becomes attorney general, politically motivated decision-making will be banished. Corrupt tactics will be halted. Restoring the integrity and credibility of the Justice Department – once a great law enforcement institution – will not happen overnight, but it will be Barr’s enduring challenge in the months ahead.

The media needed the raid, the media does not need the content.

So with all of that said, there exist a multitude of motives for the “small group”, and those who support the “small group” to oppose President Trump’s personal lawyer Michael Cohen. Consider the bigger picture behind their prior activity, engagements and motives therein. In the aggregate they have not been challenged, stopped or blocked; and as a result all of those ideological allies have nothing to lose.

Adding fuel to the multidimensional motive, the U.S. media apparatus, writ large, is in alignment with the “small group” objectives.

The evidence of the media motive surfaces amid dozens of leaks surrounding the FBI raid against Michael Cohen. From those leaks hundreds of stories are being written regardless of accuracy. What each of those stories has in common is the baseline that the FBI took information from the raid. This is the critical point to understand.

The actual content recovered from the FBI raid is irrelevant. What the media needed was the raid itself. The raid presents the factual cornerstone of every written article – from which any false assertion can be made about the content. The media needed the raid, the media does not need the content. See how that works? We are seeing this now in hundreds of articles based on anonymous sources who frame the narrative of content.

Accepting this reality we discover the big picture “small group” motive. That motive facilitated by those same ideological allies who conducted the 2016 campaign against the candidacy of their enemy, Donald Trump.

Now, there may be voices who have yet to understand the full scope of just how badly the DOJ and FBI is corrupted by politics. There are still some voices, co-dependents in their own abuse, who don’t understand or have forgotten the recent political history of the FBI and DOJ as it relates to other matters of ideological opposition.

Those co-dependent voices seem to overlook, or forget, a recent Federal Judge dismissing the entire case against the Bundy family because of gross DOJ misconduct:

U.S. District Court Judge Gloria Navarro dismissed the charges against the four men “with prejudice,” meaning they cannot face trial again. She said a new trial would not be sufficient to address the problems in the case. A federal judge on Monday said the federal prosecutors’ conduct was “outrageous” and “violated due process rights” of the defendants. (link)

Those co-dependent voices seem to overlook, or forget, a stunning rebuke of ALL DOJ attorneys in the DAPA case as outlined in a judicial ruling by Federal Judge Andrew Hanen:

“The United States Department of Justice (“DOJ” or “Justice Department”) has now admitted making statements that clearly did not match the facts. It has admitted that the lawyers who made these statements had knowledge of the truth when they made these misstatements. The DOJ’s only explanation has been that its lawyers either “lost focus” or that the “fact[s] receded in memory or awareness.” [Doc. No. 242 at 18]. 2 These misrepresentations were made on multiple occasions starting with the very first hearing this Court held. This Court would be remiss if it left such unseemly and unprofessional conduct unaddressed. 3 (read 28-page ruling)

So… it’s not a matter of ‘if’ the DOJ was/is a corrupt organization, entirely infected by political ideologues at almost every level, that troubling reality exists; it is a fact supported by those who should know best – federal judges who see the gross ideological corruption.

The FBI is structurally broken. The organization is fractured beyond repair by political ideologues who operate at all levels. It does no good to continue looking at the situation through a false prism. Facts, evidence and actual behavior must be accepted.

FBI agents who were doing an honest job would not be conducting secret activities, falsifying evidence to FISA Courts, engaging in unlawful FISA-702 searches and shaping their investigations based on their sentiments toward the targets therein. That’s just a fact; and it doesn’t take your accepting it, to change the truth of it.

Unfortunately the oft-used “we support the field agents, and are not talking about the FBI people in the various field offices etc.” is a bunch of co-dependent enabling of our abusers. It is simply a bunch of hogwash feel-good double-speak; it’s also entire false.

Ask the Parkland, Florida parents about the Miami FBI field office and their opinion therein. Ask the families of the Orlando Pulse nightclub victims about their opinion of the Orlando FBI field office. Ask the families in/around San Bernardino, California how they feel about their local FBI field office. Ask Garland, Texas. Ask, runners in/around Boston, Massachusetts, how they feel about the FBI local field office.

You see, just like the DOJ from Oregon to Texas, the FBI issues are not limited to the offices in Washington DC.

So yeah, the FBI raid on Michael Cohen’s home, office and apartment in New York is just as connected to the systemic ideological enterprises that exist in all manner of other DOJ and FBI examples. The intents are entirely political and the outcome therein is entirely predictable.

If anyone from the FBI or DOJ want to prove me wrong. Please; go ahead. You don’t have to do much to prove it. I’ll accept the absence of Michael Cohen leaks and media stories as evidence of your commitment therein. However, I won’t be holding my breath.

Un-corrupting the Department of Justice

Government corruption. It was easy for Obama to corrupt the Department of Justice. He simply put in place people who had no respect for the rule of law and, instead, ran things purely through a political filter.

Sadly, un-corrupting the DOJ (not to mention other government agencies that became equally corrupted) will be a more difficult task. It’s not just a matter of cleaning out the bad employees and replacing them with good ones. The corrupt employees created vested interests, and those who benefitted from the corruption will fight tooth and nail to protect those interests — and they’ll do so, moreover, by accusing the new broom of itself being politicized.

...even the act of returning to the rule of law is a political one that the Left will viciously challenge.

...In an unhealthy society, though, one ends up with a situation such as that which Obama created, which is that the minority dictates to the majority. That is a direct blow to American democracy, because it makes our votes and other civic choices meaningless. The minority should be zealous in defending its rights, and decent people must ensure a minority’s protection, but it’s Looking Glass Land when the minority takes over.

228 Department of Justice employees are financially invested in Hillary avoiding prosecution

David Bossie, president of campaign watchdog group Citizens United, thinks there might be a slight conflict of interest in the Department of Justice. The Washington Free Beacon reports that

Clinton collected $73,437 from individuals who listed the “Department of Justice” as their employer. Twelve of the 228 contributions were for $2,700, the maximum individual amount allowed by law.

The fundraising haul marks a dramatic increase over Clinton’s unsuccessful presidential run in 2008, when she took in 23 contributions totaling $15,930 from employees at the agency, according to data compiled by the Center for Responsive Politics.

Trump, by comparison, has received little help from Justice Department employees, recording justtwo contributions for a total of $381.

Sanders has taken 51 donations totaling $8,900 from Justice Department employees.

Bossie stated,

“I’m not surprised in the least to see more evidence that shows the politicization of the Justice Department. How can Democrat political appointees fairly investigate someone who is about to become their nominee for president? That’s why last July I called on Attorney General Lynch to appoint an impartial special counsel to investigate the private Clinton email server.”

“Today, I renew my call that Attorney General Lynch must appoint a special counsel to determine if Hillary Clinton or her agents broke the law and compromised our national security,” he continued. “This investigation needs to be conducted free of political influence once and for all.”

At Politistick Greg Campbell reports that

Howard Krongard, the former inspector general of the State Department, has already noted that the case against Clinton is not likely to result in an indictment despite the overwhelming evidence of her guilt. Krongard claims that a decision to indict would have to pass through “four loyal Democratic women.”

FBI, IRS, and DOJ officials illegally collaborated against Obama's political opponents

I love the work of Judicial Watch, and also the Washington Free Beacon. Time after time they break important stories and uncover important documents. Chris Safran reports in the Free Beacon that the IRS

supplied the FBI with 21 computer disks containing 1.25 million pages of confidential information from more than 113,000 tax returns.

...“The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection, and this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information,” Tom Fitton, president of Judicial Watch, said in the release.

...The new documents shed light on the relationship between various agencies in the Obama administration and their plans to gain access to unredacted documents forbidden under federal tax law, according to Judicial Watch.

Judical Watch writes: The Obama administration appears to have a terrorist “hands off” list that permits individuals with extremist ties to enter the country, according to internal Department of Homeland Security (DHS) documents obtained by a United States Senator.

IRS Scandal now includes Justice Department

Katie Pavlich writes that Eric Holder's Department of Justice is now implicated, along with Lois Lerner, in the IRS scandal.

“These new emails show that the day before she broke the news of the IRS scandal, Lois Lerner was talking to a top Obama Justice Department official about whether the DOJ could prosecute the very same organizations that the IRS had already improperly targeted,” Judicial Watch President Tom Fitton said in a statement. “The IRS emails show Eric Holder’s Department of Justice is now implicated and conflicted in the IRS scandal. No wonder we had to sue in federal court to get these documents.”

The President subverts DOJ investigation of the IRS

The Ulsterman Report shows how President Obama openly subverted the Department of Justice's investigation of the I.R.S.

Obama, while decrying the routine practice of journalism – it focuses on too many bad things, he whined – wandered into a declaration that the IRS targeted conservative groups for “bureaucratic reasons” – as opposed to a criminal reasons – and that agents weren’t intentionally singling out “Tea Party folks.”

Obama: "If on the other hand, you’ve got an office in Cincinnati in the IRS office that I think for bureaucratic reasons is trying to streamline what a difficult law to interpret about whether non-profit is actually a political organization deserves a tax exempt agency , and they’ve got a list, suddenly everybody’s outraged."

If this sounds like mere typical Obama indignation, let me remind you of something. The Justice Department is currently investigating whether crimes were committed by IRS officials in this affair.

Pretend you’re a career DOJ investigator who is trying to take the probe seriously, and you’re attemptng to find out if there was criminal behavior as IRS agents zeroed in on the tax status of groups opposed to the reelection of the president of the United States.

Well, the boss just gave you your answer. So please, do stand down.
