A group of seven states including New York, Connecticut, New Jersey, Rhode Island, Washington, Massachusetts and Virginia, along with New York City, sued the DOJ in 2017 after then-AG Jeff Sessions announced the DOJ would start withholding funding from local governments that refused to share information about undocumented immigrants or provide jail access to federal authorities investigating inmates’ immigration status.

Today a three-judge panel on the 2nd Circuit Court of Appeals unanimously overturned a prior district court ruling saying the DOJ lacked the authority to impose immigration-related conditions on funding. [Ruling Here]

Sanctuary for whom?

A California sheriff whose officers were led on a wild chase earlier this week by a twice-deported illegal immigrant killer says cops are “very frustrated” with sanctuary state laws preventing them from working with Immigrations and Customs Enforcement agents.

The comments from Tulare County Sheriff Mike Boudreaux come following the death of Gustavo Garcia, a 36-year-old who police say embarked on a 'reign of terror' robbing a convenience store, shooting and killing a person and firing at buildings before crashing a truck that he had stolen. The day-long crime spree that began Sunday in the Fresno area also left five injured, including one critical, and Lindsay Police suspect Garcia was involved in an additional murder there.

During the chase Monday that ended in the crash that left Garcia dead, he drove the wrong way at speeds of up to 100 mph and hit four other cars – something that he appeared to have done on purpose, police said.

“We are very frustrated with the fact that the way the laws are set up currently that law enforcement hands are tied,” Boudreaux said Wednesday, noting that in years past, Garcia – who had been in police custody shortly before the rampage -- would have been handed over to ICE in cooperation with them.

The immigration agency says it placed a detainer on Garcia last week after he was arrested on a misdemeanor charge of being under the influence of a controlled substance. But Boudreaux said he had no choice but to let Garcia go since state law prohibits him from honoring that request unless ICE obtains an arrest warrant with the signature of a federal judge.

“Gustavo Garcia in times past would have been turned over to ICE officials. Even though it was a misdemeanor charge, they placed a detainer on him. That detainer can no longer be recognized,” Boudreaux said.

“That’s how we did it in the past and that’s how we had always done it. And now, that tool has been taken from law enforcement,” Boudreaux continued. “After [the passage of] SB-54 we no longer have that power.

“That tool has been removed from our hands and because of that our county was shot up by a violent criminal that could have easily been prevented had we had the opportunity to reach out to our fellow counterparts,” he added.

Senate Bill 54, enacted in September last year by state Democrats on a party-line vote, was drafted on the premise that undocumented immigrants would feel safer going to police to report crimes and aid in investigations if they didn’t have the risk of detention, according to the Washington Post.

Sanctuary?

There can be no sanctuary where there is no safety. One huge factor in providing safety is through the enforcement of laws. When laws are ignored, criminals run rampant. When criminals operate unhindered citizens are not safe. It is my belief that this is our current situation in much of America.

So-called sanctuary cities are more concerned with protecting illegal immigrants than in enforcing the laws. This means they are protecting criminals. ‘Cause someone who has illegally entered this country is guilty of breaking the law and is, therefore, a criminal.

When criminals are protected over and above the citizenry, there is no sanctuary for the citizens. That is where we stand today. Sad. Very sad.

Preserving the rule of law

...California’s once-unrivalled status as the country’s most educated state has long since disintegrated under the waves of low-skilled, low-social-capital Mexican and Central American immigrants. Now, California's K-12 system rivals Mississippi and Alabama as an education backwater. The state’s school-age population, now majority Hispanic, lacks competitive linguistic and math skills. (Of course, defense counsel conducted part of their post-verdict press conference in Spanish, oblivious to the symbolism.) California is becoming another Brazil, divided between fabulously wealthy elites hunkered down in their own coastal sanctuaries, and a poor, Third World population. Before the rest of the country ends up in the same situation, the immigration policies that gave rise to the Steinle homicide must change. Attorney General Jeff Sessions has been conducting a largely unheralded effort to end sanctuary jurisdictions, but the illegal-alien lawyer’s lobby has fought him at every turn.

...Sessions’s efforts would be immensely aided if Congress finally passed the No Sanctuary for Criminals Act sponsored by Virginia congressman Bob Goodlatte. That bill would clarify ICE’s authority to enforce federal detainer requests and would confirm the attorney general’s authority to withhold federal funding from scofflaw jurisdictions. Most importantly, it would allow both the federal government and victims of sanctuary policies to sue sanctuary governments. The Steinle family had sued San Francisco and former sheriff Ross Mirkarimi in 2016 for their failure to notify ICE of Garcia Zarate’s release, but a federal judge threw out the case earlier this year. The Goodlatte bill would have allowed their suit to proceed. The passage of “Kate’s Law,” which lengthens the federal sentences for felonious reentry following deportation, is less urgent.

While building a border wall is an important part of a sound immigration policy, preserving the rule of law inside the country is even more important. The advocates’ agenda is clear: they want to stop all deportations and in so doing eviscerate our sovereignty once and for all. Their ultimate aim is to transform the country culturally and demographically. Sanctuary policies are one of their most powerful weapons in that crusade.
